This service has been launched to enable you to purchase products directly from durex. The service is available to residents of Australia and New Zealand. "Durex", "us", "we" or "our" means SSL Australia and New Zealand proper company names whose head office is 225 Beach Rd, Mordialloc, VIC, 3195.

"You" and "your" means the person ordering products from Durex.

General

If a product is unavailable, we will always inform you of this before the order is confirmed.

A legally binding contract with you will come into effect when we debit your credit card. We will debit the price, any applicable goods and services tax ("GST") and any delivery charge.

You warrant that you are over the age of 18 and have the authority to enter into the contract.

Details, pictures, illustrations and other descriptions contained on our website are for indicative purposes only.

All products are supplied for personal use and are not intended for resale.

We reserve the right to not accept your order.

From time to time we may change our Terms & Conditions. Accordingly we recommend that you check this page periodically in order to review our current policy.

These terms and conditions and all sales via the Durex service shall be governed by and construed in accordance with the laws of Victoria, Australia and subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Provided that where any products are purchased for delivery in New Zealand then the contract shall be governed by the laws of New Zealand and the parties submit to the jurisdiction of the Courts of New Zealand.

Pricing Policy

Every item is described as accurately as possible. The correct price is that which is displayed on this website at the time we receive your application, with the exception of a mistake where a pricing error is discovered or for reasons beyond our reasonable control, for example alterations to the rate of value added tax.

The correct price will be confirmed to you in the Dispatch Note enclosed with the goods on delivery. If the correct price is higher than the price displayed on the website, you may return the goods within our 28 day approval in new condition. Your statutory rights remain unaffected by this policy.

All prices are inclusive of any applicable GST. You may request a tax invoice at the time of purchase.

You can make payment using any of the following cards: For Australia Visa, Mastercard and Australian Bankcard

Your card will be debited with the value of your order and will appear on your statement as "SSL International".

Delivery

We deliver direct to your home, or if more convenient your place of work. Our standard delivery service normally takes 5 to 10 working days (excluding weekends and public holidays) for all stock items.

Warranties & Defects

1. It is the responsibility of the Customer to satisfy itself as to the condition, quality, suitability and fitness of goods for any particular purpose and no representation, warranty or undertaking in relation to the goods has been or is made or given by or on behalf of DUREX in relation thereto.
2. DUREX will not be responsible for any shortages or damage suffered to goods while in transit. Claims for breakages, damages and shortages during transit must be made to the carrier or delivery agent.
3. DUREX shall have no liability in respect of any defect arising from misuse, wilful damage, negligence, failure to follow instructions, unauthorised alteration or modification, abnormal working conditions or fair wear and tear.
4. DUREX shall not be liable to the Customer for any indirect, special or consequential loss or damage even if such loss were reasonably foreseeable or DUREX had been advised of the possibility of the Customer incurring same. If it shall be held that DUREX has any liability to the Customer then, except as expressly set forth in these terms and conditions, the liability of DUREX to the Customer shall not exceed the lesser of:
   1. The value of the goods the subject of any claim; or
   2. the contract price.
5. DUREX shall have no liability arising from, and may correct at any time, any typographical, clerical or other error or omission in any sales literature, price list, quotation, invoice, communication or other document or information issued by it.
6. Nothing in these terms and conditions shall affect the rights of New Zealand customers under the Consumer Guarantees Act 1993.
